NOTARIES (MISCELLANEOUS PROVISIONS) RULES 2002

 

PART I: PRELIMINARY

1.             Citation and Commencement

1.1.                 These rules may be cited as the Notaries (Miscellaneous Provisions) Rules 2002.

1.2.                 These rules shall come into force on the 1st day of May 2002

2.             Interpretation

In these rules:

'1998 Rules' means the Notaries (Qualification) Rules 1998;

'2000 Rules' means the Notarial Appeals and Hearings Rules 2000;

'Board' means the Notarial Advisory Board established by rule 3;

'Master' means the Master of the Faculties;

'Qualifications Board' means the Board established by rule 7.1 of the 1998 Rules; and

'Registrar' means the Registrar of the Court.

PART II: NOTARIAL ADVISORY BOARD

3.             Establishment of Board

3.1.          There shall be established a Notarial Advisory Board.

3.2.          The Board shall comprise the members from time to time of  the Qualifications Board and the chairman of the Qualifications Board shall also be chairman of the Board.

3.3.          The Board shall meet as necessary and may meet immediately before or immediately after a meeting of the Qualifications Board.

4.             Functions of the Board

The functions of the Board shall be to advise the Master and the Registrar on any matter pertaining to the notarial profession in England and Wales and its regulation that may be referred to it by the Master or the Registrar or that it may of its own motion wish to consider.  

PART III: MISCELLANEOUS AMENDMENTS

5.             Amendments to the 2000 Rules

5.1.          In rule 4.2 of the 2000 Rules '4.1' shall be substituted for '5.1'.

5.2.          In rule 6 of the 2000 Rules after 'Rule 8' there shall be inserted '(except Rules 8(1) and 8(3)(c)(ii))' and after 'Part III' there shall be inserted '(except Rules 8(d) and 9(b)(ii))'.
