Failure to Prevent Fraud offence

The “failure to prevent fraud” offence contained in sections 199-206 of the Economic Crime and Corporate Transparency Act 2023 will come into effect on 1 September 2025.

The Government has produced guidance (November 2024) on this new offence to which the attention of notaries is drawn.
