Consultation on Electronic Documents and Remote Appearance – Code of Practice
The Faculty Office is consulting on two new chapters to its Code of Practice:
- Electronic documents and electronic notarial acts.
- Remote appearance (ie conducting notarial acts using video conference
If the chapters are approved by the Master of the Faculties, notaries will need to have regard to them.
The Purpose of the chapters is to provide high level guidance, state which outcomes the notary should set out to achieve and to give examples of good practice and bad practice. The guidance is not intended to be prescriptive about detailed practice matters.
The Faculty Office should be grateful to receive any comments about the proposed chapters, either as to their accuracy or their appropriateness.
The consultation will close at 12.00pm on Monday 2nd February 2025.

Subject to comments, the chapters will then be made by the Master and have immediate effect.
Consultation on Electronic Documents and Remote Appearance
**On 2 December 2025 the consultation document was amended to delete the words “and industry bodies such as the Internation Union of Notaries (UINL)”. This wording was left in erroneously as the Faculty Office consider it inappropriate to incorporate such guidance by external bodies into the Code of Practice, however valuable such guidance may be.**
